This study assesses Kelsenian democratic theory.

This article pays special attention to the large number of references to political theology by Hans Kelsen and Carl Schmitt, particularly in the interwar period, and seeks to interpret these references in a new way. While Schmitt's analogies between God and state are to be expected considering his strong Catholic roots, such comparisons are much more surprising for a positivist like Hans Kelsen, who always tried to relieve state and law from transcendental elements. The article concludes that, far from being (...) marginal in the doctrinal dispute between Schmitt and Kelsen, references to political theology express and summarize their major controversy about the relation between state and law, as well as about the sources of the state's unity. The heart of the disputatio between the two jurists concerned the ability of the political power to emancipate itself from the juridical order. The ‘legal miracle’—in this context meaning the occasional autonomization of the state from law—was for Schmitt the manifestation of sovereign power. However, for Kelsen it represented the negation of the state's essence, whose actions must be determined only by the legal order. (shrink)

La doctrine de l'État de Cari Schmitt, souvent délaissée au profit d'autres facettes de son œuvre, constitue pourtant le lieu où s'incarnent ses théories du politique et de la Constitution. Le juriste allemand y consigne les bouleversements institutionnels traversés par l'Allemagne au XXe siècle. En 1914, il pense encore l'État dans sa conformité à la légalité, alors qu'à la chute de l'Empire, il ne considère les organes étatiques que dans leur usage de la décision et leur aptitude à affronter les (...) situations d'exception. Dans une perspective inédite, à partir d'une étude systématique de ses écrits relatifs à l'État, cet ouvrage relie la théologie politique de Schmitt, son anti-individualisme, comme sa définition singulière du politique, à ses propositions de refonte des institutions. La reconstitution de sa doctrine de l'État éclaire d'un jour nouveau l'affrontement entre ses partisans et ses adversaires et explique, malgré les compromissions avérées de Cari Schmitt avec le nazisme, la persistance de sa pensée dans la vie intellectuelle après Nuremberg. This paper focuses on Hans Kelsen’s reflections on political parties. During the interwar period, Kelsen participated in a controversy over whether political parties were a necessary part of the democratic process. The debate forced Kelsen to produce a defence of political parties to emphasise their functionality and define their place in his particular definition of democracy. This contribution considers the following aspects. First, the reasons why Kelsen thought political parties are necessary for democratic life are explained. Second, the doctrinal oppositions (...) against which he elaborated his defence of political parties are clarified. Third, the programme that Kelsen conceived of to enhance political parties in a constitutional democracy is examined. Finally, the contemporary questions that have arisen in relation to Kelsen’s conception of political parties are scrutinised. Kelsen’s contribution to the debate about the role of political parties was intimately related to the presence of strong criticisms of that role. This makes his reflections even more interesting today, considering the present relative decline of the political role and appeal of parties. (shrink)

This research explores the character’s decline in Christopher Marlowe’s play Doctor Faustus. It tells the story of an intellect entitled Dr. Faustus who, after becoming dissatisfied with every piece of the experience he has accumulated, goes to see the devils to satisfy his ambition of becoming a supreme being. Evaluating the reasons behind his demise is the focus of this research. This research is qualitative in nature. The Baum proposal for this type of study serves as the foundation for the (...) investigation’s methodology used in this analysis. The fall from grace concept is based on Sinclair’s argument that a specific individual or system’s collapse or catastrophe occurs after they have recently achieved happiness or influence. The conclusion reveals that Faustus’s failure to discriminate between the real world and his fantasies, uncontrolled necromantic action, and overwhelming yearning is what ultimately lead to his disaster and condemnation. In the end, it is revealed that while Faustus initially appears to be the unfortunate protagonist of the narrative, he encounters the death he deserves. (shrink)

Background: As actors with the key responsibility for the protection of human research participants, Research Ethics Committees (RECs) need to be competent and well-resourced in order to fulfil their roles. Despite recent programs designed to strengthen RECs in Africa, much more needs to be accomplished before these committees can function optimally.Objective: To assess training needs for biomedical research ethics evaluation among targeted countries.Methods: Members of RECs operating in three targeted African countries were surveyed between August and November 2007. Before implementing (...) the survey, ethical approvals were obtained from RECs in Switzerland, Cameroon, Mali and Tanzania. Data were collected using a semi-structured questionnaire in English and in French.Results: A total of 74 respondents participated in the study. The participation rate was 68%. Seventy one percent of respondents reported having received some training in research ethics evaluation. This training was given by national institutions (31%) and international institutions (69%). Researchers and REC members were ranked as the top target audiences to be trained. Of 32 topics, the top five training priorities were: basic ethical principles, coverage of applicable laws and regulations, how to conduct ethics review, evaluating informed consent processes and the role of the REC.Conclusion: Although the majority of REC members in the targeted African countries had received training in ethics, they expressed a need for additional training. The results of this survey have been used to design a training program in research ethics evaluation that meets this need. (shrink)

Hypnosis is considered a unique tool capable of modulating cognitive processes. The extent to which hypnotic suggestions intervenes is still under debate. This study was designed to provide a new insight into this issue, by focusing on an unintentional emotional process: attentional bias. In Experiment 1, highly suggestible participants performed three sessions of an emotional Stroop task where hypnotic suggestions aiming to increase and decrease emotional reactivity towards emotional stimuli were administered within an intra-individual design. Compared to a baseline condition (...) (without hypnotic suggestion), a significant increase in attentional bias was found when a hypnotic suggestion to increase emotional reactivity was administered. In contrast, the bias was eliminated when a suggestion to decrease emotional reactivity was administered. Experiment 2 investigated the effect of session repetition on attentional bias across three successive experimental sessions without hypnosis, and showed that the emotional Stroop effect did not vary across sessions. Hence, session repetition could not account for part of the modulation of attentional bias in Experiment 1. Taken together, the results suggest that specific hypnotic suggestions can influence elicitation of unintentional emotional processing. The implications are discussed regarding the locus of intervention of hypnotic suggestion in cognitive and emotional processes. (shrink)

Discussion of gentrification is ubiquitous in cities around the world. And while criticism of it is common, there is still considerable contestation over whether gentrification is unjust. Political theorists have recently turned their attention to the normative evaluation of gentrification, especially the displacement of long-term residents from neighbourhoods experiencing redevelopment and reinvestment. Two important limitations in this recent work are, first, a narrow focus on the link between gentrification and displacement, and second, the injustice of gentrification has been evaluated in (...) light of abstract ideals of justice divorced from the lived experience of its harms. Although the emerging literature usefully identifies some of the harms of gentrification, it fails to recognise the full extent of the injustice of gentrification. To address these limitations, I argue the normative evaluation of gentrification should start with a conceptualisation of the problem grounded in the experience of its negative effects. Further, employing a more comprehensive conceptualisation of gentrification’s negative effects reveals it to be a distinctive and encompassing urban injustice better understood by examining how gentrification is defined by harmful inequalities of political power, leading to exploitation, dispossession, displacement, marginalisation, and violence. The results showed that among the older participants, R responses decreased, but K responses did not. Moreover, a hierarchical regression analysis supported the view that the effect of age in recollection experience is determined by frontal lobe integrity and not by diminution of processing speed. Remaining important tasks in finding and developing new drugs and vaccines for HIV/AIDS, malaria, cancer and other diseases require continued industry research and development. Industry’s research and development pipeline has produced drugs that have saved AIDS victims previously facing certain death, but still no cure nor vaccine is yet available. Experience with the process of research and development indicates that it requires more than a decade of development to produce a new drug with costs in the hundreds of millions of (...) dollars. Intellectual property protection is critically important in assuring that drug development continues. Partnerships between industry and the public sector have increased access to new therapies in developing countries and promise to enhance access to both patented and generic medicines in the future. Der Beitrag fragt nach dem Stellenwert des Normalitätsbegriffs im Diskurs der Behinderung. Ausgangspunkt ist die These, dass Normalität und Normativität analytisch voneinander getrennt werden müssen. In der heutigen Normalisierungsgesellschaft existieren sowohl wertbezogene, präskriptive ("normative") als auch statistisch fundierte, deskriptive ("normalistische") Normen. Außerdem lassen sich zwei Normalisierungsstrategien kennzeichnen: ein starr ausgrenzender, normierender Ansatz ("Protonormalismus") und eine flexible, normalisierende Strategie ("flexibler Normalismus"). Auf dieser theoretischen Folie wird diskutiert, ob sich im behindertenpolitischen Diskurs und in sozialpolitischen Konzepten Tendenzen der flexiblen Normalisierung auffinden lassen. (...) Der Schwerpunkt des Beitrags liegt auf einer normalitätstheoretischen Analyse der beiden Klassifikationsmodelle der Weltgesundheitsorganisation. Die "International Classification of Impairments, Disabilities and Handicaps" (ICIDH 1980) blieb noch der wertbezogenen Normativität verhaftet. In diesem Artikel geht es um die Beziehungen zwischen der von Jürgen Habermas entwickelten Diskursethik und den Studierendenseminaren, die der Ulmer Arbeitskreis „Ethik in der Medizin“ veranstaltet. Zunächst erfolgt eine Darstellung der Kernaussagen der philosophischen Diskursethik. Sie liefert eine formale Argumentationsprozedur, mit der es möglich ist, die Legitimität strittig gewordener Normen im Diskurs zu prüfen. Anschließend wird das in Ulm von Baitsch und Sponholz entwickelte Modell der Seminare „Ethische Entscheidungskonflikte im ärztlichen Alltag“ vorgestellt. Da sich die Ulmer Seminare unter anderem (...) auf die Diskursethik als theoretischen Hintergrund berufen, werden die Gemeinsamkeiten und Unterschiede beider Konzepte untersucht. Der Hauptunterschied ist der zwischen einem Begründungs- und einem Anwendungsdiskurs. Gemeinsam sind den Ansätzen die grundsätzlich kognitivistische Einstellung und die „Spielregeln“ des Diskurses. Der Einsatz empirischer Forschungsmethoden in der Medizinethik hat zu Forderungen nach einem gewandelten Selbstverständnis der Medizinethik geführt, die sich mehr als eine integrierte Disziplin aus Sozialwissenschaften und Ethik verstehen solle. Dagegen wird hier die These vertreten, dass über Sinn und Unsinn des Einsatzes empirischer Methoden zunächst eine moralphilosophische Diskussion erforderlich ist. Medizinethiker müssen ausweisen können, welche empirischen Forschungsresultate zur Beantwortung normativer Fragen erforderlich sind. Ein solcher Ausweis beruht seinerseits jedoch auf normativen Annahmen, die ihrerseits moralphilosophischer Legitimation bedürfen. Der Beitrag untersucht (...) daher den Einsatz empirischer Methoden in der Medizinethik im Hinblick auf Verhältnis von ethischem Grundlagendiskurs und Methodologie der angewandten Ethik. Abschließend wird gefragt, ob nicht ein Großteil von empirischen Studien in der Medizinethik aus forschungsethischen Gründen problematisch ist. (shrink)

Education is presently required to create inclusive, supportive, and validating environments for education and experiences, while educational organizations continue to maintain students from many different kinds of cultural and socially diverse backgrounds. This research investigates how students engage and collaborate with diverse cultures and social environments to identify the key features influencing their social relationships and learning outcomes. To determine the possibilities and difficulties that students experience in a varied educational environment and make suggestions for the enhancements and assessment techniques (...) for fostering a multicultural and diverse classroom. In this research, the details gathered from 350 students, and utilize 15 questionnaires related to cultural and social diversity in education that were developed, based on five variables, such as students attitudes towards diversity (SATD), impact on the learning environment (ILE), cultural awareness (CA), perception of cultural and social diversity (PCSD), and social interactions (SI). The Wilcoxon-Mann-Whitney test and inferential statistics analysis methods are evaluated through the SPSS software. From both analyses, the variable PCSD performance is higher than other four variables in the field of student perception of social and cultural diversity in education. (shrink)

Die demografische Entwicklung und der medizinische Fortschritt werden die Problematik der Ressourcenknappheit im deutschen Gesundheitswesen in Zukunft weiter verschärfen. Soll nicht nur kurzfristig akuten Sparzwängen ausgewichen werden, steht – wie in verschiedenen Ländern bereits geschehen – auch Deutschland auf Dauer eine Prioritätensetzung im Gesundheitswesen bevor. Diese sollte in möglichst transparenter Weise nach klaren Kriterien erfolgen. Eines der seit einiger Zeit häufig öffentlich zitierten Kriterien der Verteilung von Mitteln in der Gesundheitsversorgung ist die Eigenverantwortung von Patienten. Deren Berücksichtigung in der Allokation (...) von Ressourcen birgt allerdings zahlreiche Probleme. Der vorliegende Beitrag untersucht die gerechtigkeitstheoretischen Grundlagen und die praktischen Probleme bzw. die möglichen Konsequenzen von Eigenverantwortung als Verteilungskriterium im Gesundheitswesen. Auf der Grundlage eines alternativen gerechtigkeitstheoretischen Vorschlags werden drei Möglichkeiten skizziert, Eigenverantwortung von Patienten im deutschen Gesundheitswesen in gerechter Weise stärker zu betonen. Demographischer Wandel und medizinischer Fortschritt haben zur Folge, dass immer mehr Patienten außerstande sind, selbstbestimmt über eine medizinische Behandlung zu entscheiden. Dann sind andere gefordert, unter Berücksichtigung von Wohl und Willen des Patienten stellvertretend zu entscheiden. Dabei bieten sich drei Entscheidungskriterien an: Paternalismus, substitutive Autonomie (mutmaßlicher Wille) und prospektive Autonomie (vorausverfügter Wille). Keines dieser Kriterien garantiert für sich genommen eine optimale Entscheidung. Realistisch ist nur ein integratives Modell, das diese Kriterien pragmatisch verbindet. Je klarer im Einzelfall die Evidenz für den (...) autonomen Patientenwillen ist, desto mehr Gewicht sollte ihm eingeräumt werden. Dabei lassen sich konkrete Schritte benennen, wie die Evidenz für eine autonome Willensbekundung beurteilt werden kann. Obgleich stellvertretende Entscheidungen in der medizinischen Praxis oft von Ärzten, professionellen Betreuern und Richtern getroffen werden, gibt es überzeugende Gründe für die These, dass der nächste Angehörige am besten geeignet ist, prima facie als stellvertretender Entscheidungsträger zu fungieren. This study uses a qualitative discourse analysis approach to investigate Pakistani female politicians' discursive representation in print and electronic media. Specifically, the research focuses on the narratives and framing strategies employed by the media to construct and portray the public image of these political figures. By employing Corpus-Assisted Diachronic Discourse Analysis (CADDA), the study traces the changes in media discourse over time, uncovering how gender biases, societal norms, and power dynamics shape the representation of women in Pakistani politics. The findings (...) reveal significant trends in gendered framing, highlighting how media portrayal fluctuates between marginalization and recognition of female politicians' contributions, though gender stereotypes remain deeply embedded in these narratives. The findings of this study have important implications for future media reform initiatives, advocating for a more equitable and balanced representation of women in politics. The insights gained can also inform gender advocacy strategies and policy efforts to enhance women's visibility and leadership roles in traditional and digital media. (shrink)

We examined liking for happy- and sad-sounding music as a function of exposure, which varied both in quantity (number of exposures) and in quality (focused or incidental listening). Liking ratings were higher for happy than for sad music after focused listening, but similar after incidental listening. In the incidental condition, liking ratings increased linearly as a function of exposure. In the focused condition, liking ratings were an inverted U-shaped function of exposure, with initial increases in liking (after 2 exposures) followed (...) by decreases (after 8 or 32 exposures). The results documented that: (1) sad music is liked as much as happy music in some instances; (2) frequency of exposure causes both familiarity (positive) and over-familiarity (negative) effects; and (3) effects of exposure on liking differ for focused and incidental listening. This volume explores the relation between legal reasoning and logic from both a historical and a systematic perspective. The topics addressed include, among others, conditional legal acts, disjunctions in legal acts, presumptions and conjectures, conflicts of values, Jørgensen´s Dilemma, the Rhetor´s Dilemma, the theory of legal fictions and the categorization of contracts. The unifying problematic of these contributions concerns the conditional structures and, more particularly, the relationship between legal theory and legal reasoning in the context of conditions.

Eines der medizinischen Felder, in dem die ethische Diskussion um die „wunscherfüllende Medizin“ am intensivsten geführt wird, ist die Reproduktionsmedizin, die die Erfüllung des „Kinderwunsches“ verspricht. Strittig ist besonders, ob Sterilität als Krankheit definiert wird, die eine medizinische Intervention rechtfertigt, ob sich aus der Sterilität oder Infertilität lediglich ein Abwehr- oder auch ein positives Anspruchsrecht auf medizinische Ressourcen ergibt, ob legitime Fortpflanzungsmedizin Grenzen hat. Nach einer Übersicht über Eckpunkte der nationalen und internationalen Debatte beschreiben wir im zweiten Teil Ansichten zum (...) Status ungewollter Kinderlosigkeit, zum Recht auf Fortpflanzungsmedizin und zur möglichen Legitimität ihrer Begrenzung anhand der Ergebnisse unserer vom Bundesministerium für Bildung und Forschung (BMBF) geförderten Studien. Während der letzten fünf Jahre haben wir u. a. Paare mit und ohne Sterilitätsproblematik sowie verschiedene Expertengruppen qualitativ und standardisiert befragt. Die stark divergierenden Auffassungen konfrontieren wir im dritten Abschnitt mit internationalen Standards, zum anderen mit dem „Capability-Ansatz“ und dem freiheitsfunktionalen Liberalismus von Sen und Pauer-Studer. Dies ergibt, dass die Bereitstellung verschiedener Möglichkeiten der In-vitro-Fertilisations-(IVF-)Behandlung nicht lediglich einen Wunsch auf Elternschaft erfüllt sondern als die gesollte Erfüllung eines normativen Bedürfnissanspruchs begriffen werden muss. We propose that institutions consider establishing a position of “Ombudsman for Research Practice”. This person would assume several roles: as asounding board to those needing confidential consultation about research issues — basic, applied or clinical; as afacilitator for those wishing to pursue a formal grievance process; and as aneducator to distribute guidelines and standards, to raise the consciousness regarding sloppy or irregular practices in order to prevent misconduct and to promote the responsible conduct of research. This study aimed to assess the prevalence of gamophobia among unmarried graduate students at Yarmouk University, Jordan, and to explore its correlation with family communication patterns. The sample comprised 255 male and female students selected through convenience sampling. The results indicated that the overall level of gamophobia within the sample was moderate. Notably, gamophobia levels were significantly higher among females and employed students compared to their male and unemployed counterparts. No significant differences in gamophobia levels related to age or educational (...) level were found. Regarding the relationship between gamophobia and family communication patterns, the study identified a significant positive correlation with four specific family role patterns and a significant negative correlation with one family communication pattern. The analysis further showed that family communication patterns ranged from medium to high, with the balanced communication pattern being the most prevalent and the blaming pattern the least. Additionally, while no significant differences in family communication patterns were observed based on gender, differences were noted in the placating pattern in favor of doctoral students, in the placating and super-reasonable patterns favoring employed students, in the placating style for the 25–30 and 30+ age groups, and the irrelevant pattern for those under 25 years old. The balanced communication pattern was more prevalent among participants aged 30 years and older. (shrink)

Im Zuge des „empirical turn“ der Medizin- und Bioethik ist von verschiedenen Autoren in den vergangenen Jahren die Idee einer „evidenzbasierten Ethik“ diskutiert worden. Die Analogie zwischen evidenzbasierter Medizin und „evidenzbasierter Ethik“ soll in diesem Beitrag kritisch diskutiert und dabei gezeigt werden, dass der Ausdruck „evidenzbasierte Ethik“ irreführend ist. Zentraler Ausgangspunkt der Kritik ist die unterschiedliche Bedeutung, die empirische Informationen für das medizinisch-klinische Urteil zum einen und das ethische Urteil in der Medizin zum anderen haben. Im medizinisch-klinischen Urteil können mit (...) Hilfe empirischer Informationen hypothetische Handlungsnormen generiert werden, welche auf den der Medizin inhärenten Zwecksetzungen basieren. Bei Fragen der Ethik in der Medizin hingegen sind die Handlungsziele selbst Gegenstand des Urteils; diese aber können allein aus empirischem Wissen heraus nicht zureichend bestimmt werden. Die Diskussion um die Möglichkeit einer „evidenzbasierten Ethik“ eröffnet weiterhin aufschlussreiche Perspektiven in Bezug auf empirische Forschung und den Umgang mit empirischen Informationen in der Angewandten Ethik und das Aufgabenfeld der Medizinethik. This study aims to explore the level of using artificial intelligence applications among university students and their impact on the credibility of e-learning. The study used the descriptive method because it is suitable for the study. The study included a sample of 94 Jordanian university students, who were selected by stratified random method. The study used a questionnaire of 40 items as the research instrument to determine the level of the use of artificial intelligence technology and distance education in distorting (...) the contemporary educational landscape. The results showed that universities try to limit the incorrect use of AI applications among students by using specific detection tools. The students showed that their universities have strict rules and regulations regarding the use of AI tools in their studies. Therefore, there were low estimations from the students on the large incorrect usage of AI tools. The results also revealed that gender and the specialization of the student do not affect their views toward the incorrect use of AI tools in their education, whether face-to-face education or online education. This article explores the ethical implications, potential consequences, and regulatory frameworks associated with the integration of AI in military contexts._.

Wie muss ein ethischer Beratungsdienst strukturiert sein, damit er in moralischen Konfliktsituationen im klinischen Alltag angefragt wird und die Ratsuchenden ergebnisorientiert unterstützen kann? Nach welchen Kriterien lassen sich die Beratungsgespräche auswerten und bewerten? Zur Beantwortung dieser Fragen werden theoretisch fundierte Konzepte ethischer Fallbesprechung aus Nimwegen, Leuven und Basel herangezogen; dies geschieht vor dem Hintergrund der Erfahrungen mit der über zehnjährigen Entwicklung der ethischen Arbeit im Ev. Krankenhaus Bielefeld (EvKB). Als Resultat stellen wir einen strukturierten, multidisziplinären Ansatz vor, mit dem in (...) den Beratungsgesprächen die ethischen Dimensionen unterschiedlicher Vorstellungen herausgearbeitet und möglichst einvernehmlichen Lösungen zugeführt werden. Am Beispiel des EvKB lässt sich zeigen, dass der ethische Beratungsdienst auch in Zeiten knapper Ressourcen implementiert und praktiziert werden kann und eine Gesprächskultur schafft, die zu neuen Zielvariablen führt; hier spielen der Perspektivenwechsel und die Prozessgerechtigkeit eine zentrale Rolle und liefern zugleich Ansatzpunkte für unsere eigene Evaluationsstrategie. Zum aktuellen Stand der Evaluation klinischer Ethikberatung wird die internationale Literatur kritisch gewürdigt. Erste konzeptionelle Ansätze und Ergebnisse einer eigenen Evaluationsstrategie werden vorgestellt. Durch die Offenlegung hoffen wir, die Auseinandersetzung mit diesen Themen zu intensivieren.
